Planning Permission for Four Dwellings at Fraddon

BLS, on behalf of Mr A. Whetter, provided town planning advice in respect of the planning permission for the construction of four dwellings on land south of No. 17 Heather Meadow, Fraddon, with the reference PA25/03870.  The application site comprised land outside of the settlement boundary identified in the St Enoder Neighbourhood Plan.  However, given that Cornwall Council does not have a five year housing land supply, the housing policies of the Cornwall Local Plan and Neighbourhood Plan are out of date and the presumption in favour of the tilted balance in paragraph 11(d)(ii) of the NPPF is engaged.  Accordingly the benefits of the application, by increasing the housing supply, outweighed any harm and the application was compliant with the NPPF and the development plan and planning permission was granted.
