BLS, acting on behalf of Westcountry Land (Kenwyn) Ltd have successfully obtained planning permission for 90 houses (23 affordable) on land outside of the settlement boundary of Roche. The application was an outline planning consent with access, scale, layout and appearance with landscaping reserved. BLS undertook the preparation and submission of the application. Given that Cornwall Council no longer has a five year supply of housing land, and the Neighbourhood Plan is out of date, the presumption in favour of sustainable development and the tilted balance was applied with paragraph 11(d)(ii) of the NPPF engaged. Substantial weight was given to the benefits associated with increasing the housing land supply in a sustainable location, with any harm being outweighed by the benefits arising from the proposal.
