BLS have won a planning appeal for a development of 28 residential dwellings on a site at St Mary's Road, Brixham following a refusal of planning permission by Torbay Borough Council. Planning permission was granted by the Secretary of State following a planning appeal which was undertaken by BLS on behalf of Westcountry Land Enterprises (South West) Ltd (Appeal Reference APP/X1165/W/25/3368343).
Notwithstanding Torbay Borough Council can only demonstrate a 1.7 year housing land supply and the site was allocated for housing development in the Brixham Peninsula Neighbourhood Plan, the Council refused planning permission. The appeal decision highlights fundamental issues in how planning applications for housing are being processed in Torbay and why the Council has a woeful track record in the delivery of housing.
